Existing visa holders may apply for an extension, provided they continue to meet the relevant requirements. <\/p>\n\n<p class=\"wp-block-paragraph\">In this article, we examine a Sole Representative visa extension application conducted through the UK subsidiary of a Turkish company.<\/p>\n\n<p class=\"wp-block-paragraph\">During the assessment of the application, the Home Office issued a comprehensive request for further evidence, including documents not specified in the published guidance. Some of the matters raised required more careful attention in the overall assessment of the application. Following a carefully prepared response to the request, the application was granted.  <\/p>\n\n<p class=\"wp-block-paragraph\">Below, we set out the three main issues that stood out during the process and how they were addressed within the application.<\/p>\n\n<h2 id=\"yeni-basvurulara-kapanmis-bir-rotada-devam-eden-uzatma-hakki\" class=\"wp-block-heading\">A Continuing Right to Extend on a Route Closed to New Applicants<\/h2>\n\n<p class=\"wp-block-paragraph\">The Sole Representative of an Overseas Business route is closed to new applicants. The current options for overseas businesses seeking to establish a presence in the United Kingdom are dealt with under different immigration routes. <\/p>\n\n<p class=\"wp-block-paragraph\">However, the closure of the route to new applicants does not remove the right of those already holding this status to apply for an extension. Sole Representative visa holders may apply for an extension provided they continue to meet the relevant requirements. <\/p>\n\n<h2 id=\"basvurunun-genel-cercevesi\" class=\"wp-block-heading\">The General Framework of the Application<\/h2>\n\n<p class=\"wp-block-paragraph\">At the heart of the application was the UK subsidiary of a Turkish company. The company had been operating in the United Kingdom for approximately three years. Sales were carried out mainly through online platforms and the business continued to grow. This indicated that the UK company was carrying on an active commercial operation.   <\/p>\n\n<p class=\"wp-block-paragraph\">The additional questions raised by the Home Office focused mainly on three areas:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>The applicant&#8217;s salary and total remuneration and benefits package<\/li>\n\n\n\n<li>The activities of the UK subsidiary and the applicant&#8217;s role in those activities<\/li>\n\n\n\n<li>The applicant&#8217;s travel outside the United Kingdom<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">At the core of the documents requested was an examination of whether the applicant was actively and continuously involved in the management of the company.<\/p>\n\n<p class=\"wp-block-paragraph\">Another notable aspect of the request was its scope. The documents requested were not limited to the UK company; documents relating to the activities, financial position and corporate structure of the overseas parent company, as well as the applicant&#8217;s own personal documents, were also requested. The assessment was therefore carried out from three separate sources: the UK subsidiary, the overseas parent company and the applicant. For this reason, the consistency of the information and documents obtained from these three sources was analysed, and the necessary explanations were prepared after confirming that there was nothing that could give rise to any contradiction or confusion.   <\/p>\n\n<h2 id=\"birinci-baslik-maas-ve-toplam-ucret-paketi\" class=\"wp-block-heading\">First Issue: Salary and Total Remuneration Package<\/h2>\n\n<p class=\"wp-block-paragraph\">Unlike work visas currently open to new applicants, the Sole Representative route does not set a fixed minimum salary threshold. The test here is qualitative rather than numerical: the salary and benefits are expected to be appropriate to the senior position held by the applicant and to remain relatively high compared with the salaries of other employees in the company. <\/p>\n\n<p class=\"wp-block-paragraph\">During the application process, the Home Office requested a detailed explanation of the applicant&#8217;s salary and benefits. In this context, salary was treated not as a fixed threshold to be met directly, but as a factor assisting in the assessment of the other requirements of the route. <\/p>\n\n<p class=\"wp-block-paragraph\">A relatively low salary may raise two key questions:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>Whether the applicant genuinely works in a full-time, senior management position<\/li>\n\n\n\n<li>Whether the applicant can support themselves and any family members from the income earned from the company without recourse to public funds<\/li>\n<\/ul>\n\n<h2 id=\"maas-paketi-ve-odemeyi-yapan-kurum\" class=\"wp-block-heading\">The Remuneration Package and the Paying Entity<\/h2>\n\n<p class=\"wp-block-paragraph\">The fact that part of a Sole Representative&#8217;s salary or benefits is met by the overseas parent company does not, in itself, conflict with the structure of the route. However, this arrangement must not overshadow the applicant&#8217;s obligation to manage the UK subsidiary on a full-time basis. <\/p>\n\n<p class=\"wp-block-paragraph\">In this application, the income the applicant received from different sources, together with the benefits provided to them, was assessed as a whole.<\/p>\n\n<p class=\"wp-block-paragraph\">That said, defending the package as a whole does not remove the need to prove each item separately. An income item that cannot be evidenced, or that does not match other records, gives rise to new questions rather than strengthening the overall package. For this reason, attention was paid not only to the total figure, but also to the internal consistency of each component making up that figure and its consistency with the other documents.  <\/p>\n\n<p class=\"wp-block-paragraph\">Because the company had by now reached a settled structure and a stable commercial operation, it was also demonstrated that, during the extension period, the salary level would be increased in line with the applicant&#8217;s seniority and actual responsibilities.<\/p>\n\n<h2 id=\"ikinci-baslik-birlesik-krallik-taki-sirketin-faaliyetleri-ve-basvuranin-rolu\" class=\"wp-block-heading\">Second Issue: The Activities of the UK Company and the Applicant&#8217;s Role<\/h2>\n\n<p class=\"wp-block-paragraph\">Another important matter the Home Office focused on was whether the UK subsidiary was genuinely active and what role the applicant played in those activities.<\/p>\n\n<p class=\"wp-block-paragraph\">The applicant&#8217;s role was not explained merely through a general job title. Their actual responsibilities within the company&#8217;s operations, sales processes and administrative activities were also set out in detail. <\/p>\n\n<p class=\"wp-block-paragraph\">Company records, commercial activity documents and explanations of the applicant&#8217;s duties were presented so as to support one another.<\/p>\n\n<p class=\"wp-block-paragraph\">Establishing a clear and verifiable link between the activities of the UK company and the applicant&#8217;s personal role was one of the fundamental elements of the application.<\/p>\n\n<h2 id=\"ucuncu-baslik-birlesik-krallik-disindaki-seyahatler\" class=\"wp-block-heading\">Third Issue: Travel Outside the United Kingdom<\/h2>\n\n<p class=\"wp-block-paragraph\">In Sole Representative visa extension applications, unlike settlement applications, there is no general limit on the total time spent outside the United Kingdom.<\/p>\n\n<p class=\"wp-block-paragraph\">Nevertheless, the Home Office requested a detailed breakdown of the applicant&#8217;s travel abroad over the three-year period.<\/p>\n\n<p class=\"wp-block-paragraph\">The focus of this request was whether the applicant had been present in the country to an extent sufficient to carry out their role in the United Kingdom, and whether the need to reside in the United Kingdom for the continuity of the business rested on a reasonable basis.<\/p>\n\n<p class=\"wp-block-paragraph\">Particularly on work routes, the purpose of long or frequent travel that could raise questions about the applicant&#8217;s role or actual working arrangements in the United Kingdom, and the effect of such travel on the business, should be capable of explanation.<\/p>\n\n<h2 id=\"kapsamli-ek-belge-talebi-nasil-ele-alindi\" class=\"wp-block-heading\">How Was the Comprehensive Request for Further Evidence Handled?<\/h2>\n\n<p class=\"wp-block-paragraph\">The first step was to identify, for each question and document in the request, which matter was intended to be assessed.<\/p>\n\n<p class=\"wp-block-paragraph\">Following this assessment, official and comprehensible documents that served the purpose directly were brought together, avoiding an excess of paperwork.<\/p>\n\n<p class=\"wp-block-paragraph\">For each heading, the necessary explanations were submitted together with the documents supporting those explanations.<\/p>\n\n<p class=\"wp-block-paragraph\">The application was granted eleven days after the response was submitted, and the applicant was given two years&#8217; leave, which is the maximum period that may be granted for extension applications on this route.<\/p>\n\n<h2 id=\"bu-vakadan-cikarilabilecek-sonuclar\" class=\"wp-block-heading\">Key Points from This Case<\/h2>\n\n<p class=\"wp-block-paragraph\">Although the core assessment in visa applications is carried out on the basis of the rules set out in the published guidance, it is an expected and commonly encountered situation in practice for the Home Office to request information and documents on matters that are not written down but are likely to be examined given the nature and purpose of the visa. For this reason, applications and responses to requests for further evidence should be prepared not on the basis of fixed rules, but in line with practice and the Home Office&#8217;s assessment approach. <\/p>\n\n<p class=\"wp-block-paragraph\">Matters such as salary, benefits or travel, for which the rules contain no explicit numerical threshold, may also gain importance when the overall suitability of the application is assessed.<\/p>\n\n<p class=\"wp-block-paragraph\">The declared income, role and commercial activity elements must be supported by reliable documents.<\/p>\n\n<p class=\"wp-block-paragraph\">A clear and verifiable link must be established between the company&#8217;s activities and the applicant&#8217;s personal role.<\/p>\n\n<p class=\"wp-block-paragraph\">Most importantly, the compliance element being assessed behind each question raised by the Home Office must be correctly analysed.<\/p>\n\n<p class=\"wp-block-paragraph\">Finally, it is worth remembering that an extension application is not a destination on this route but an intermediate stop. At the settlement stage, the assessment criteria change: while the Life in the UK Test and the language requirement come into play, the time spent outside the United Kingdom, which is not subject to a general limit at the extension stage, becomes directly binding at the settlement stage, and the entire five-year period is re-examined in this respect.
