Innovator Founder Route Details

As we mentioned in our previous blog post, there were some critical changes in the Innovator Founder route. With this change, we stated that the Start-up route was removed and replaced by the Innovator Founder route as of 13 April 2023.

Today, we would like to give you detailed information about the Innovator Founder route. The Innovator Founder Route is for people who want to start a business in the UK based on an innovative, viable and scalable business idea that they have produced or significantly contributed to.

To be eligible for this route, you must first have a business idea. It must be new, innovative, viable, and scalable (your business idea must have evidence of planning that includes job creation and growth in national and international markets). You must also demonstrate that you have a B2 level of English from an authorised test centre (e.g. IELTS) or that you have previously graduated with a bachelor’s degree or higher from an English-medium institution.

The business idea must be assessed and approved by one of the government-authorised bodies (one of the Endorsement Bodies) in the UK before application. The business plan, which describes the business idea in detail, is essential to this approval process. The business plan describing your business idea must be up to date, following the requirements, detailed and original.

What can you do?

With this visa, you can set up one or more businesses and work for your business (for example, you can employ yourself as a manager).

You can also work outside your business if it is ‘skilled work’ (for example, you can work in a job on the Skilled Worker list).

Under this visa, you can apply for permanent residence (ILR) at the end of three years if you fulfil all the necessary conditions.

Indefinite Leave to Remain Requirements

To obtain permanent residence through the Innovator Founder route, every applicant must meet requirements, regardless of visa type. In addition, at least two of the following conditions must be explicitly met for the Innovator Founder route:

1- At least £50,000 must have been invested in the business and actively spent to further your business,

2- The number of customers of the business has at least doubled in the last three years and is now higher than the average number of customers of other UK businesses offering comparable core products or services,

3- The business has created the equivalent of at least five full-time jobs with an average salary of at least £25,000 per annum for resident employees,

4- The business has generated an annual gross revenue of at least £1 million in the last full year covered by its accounts,

5- The business has generated annual gross revenues of at least £500,000 in the last full year covered by its accounts, of which at least £100,000 is from overseas exports,

6- The business is engaged in significant research and development activities and has applied for intellectual property protection in the UK,

7- The business has created the equivalent of at least ten full-time jobs for resident employees with no average salary requirement

Significant Changes in Global Talent and Startup/Innovator Visa

We would like to give you brief information about the latest Immigration Regulation changes announced in March but will come into effect gradually from April 12.

The most striking changes have been made in the Global Talent and the Startup/Innovator visa. As the changes affecting the Global Talent visa are more restrictive, those who intend to apply in this route should speed up their process.

What has changed? 

1- Electronic Travel Authorisation (“ETA”)

  • The program is available for citizens of Qatar from 15 November 2023. From 15 February 2024, it will also apply to nationals of Bahrain, Jordan, Kuwait, Oman, Saudi Arabia and the United Arab Emirates. The ETA scheme is an arrangement for third-country national travellers visiting the UK who do not currently need a visa for short stays.

2- Innovator Founder Route

  • The Innovator Founder route is a new route for overseas nationals looking to enter the UK to start an innovative business. This route removes the £50,000 minimum funding requirement currently imposed on UK arrivals to provide a more flexible provision for those with a genuine bid for innovative business and sufficient funds to do so. With this change, the Start-up route is abolished and replaced by the Innovator Founder route as of April 13, 2023.

3- Updates for the Skilled worker route

  • Salary requirements for Skilled worker visa have been updated, and the minimum salary threshold for Skilled Worker visas has been updated from a minimum of £25,600 to £26,200 per year. The change will take effect from April 12, 2023.

4- Updates for the seasonal worker route

  • The minimum working time of 30 hours for seasonal workers in horticulture has been changed to 32 hours per week. The change will take effect from April 12, 2023.

5- Updates for the Global Talent route

  • At Arts & Council England’s request, a CV showing the current stage of the applicant’s career in arts and culture is required, in addition to the existing documents to be submitted. We can consider this change as positive among the other changes. Currently, those who applied for the Global Talent visa via the IT route with Tech Nation were adding their CVs to their files. However, for Arts&Council applicants who already have a specific page restriction, adding a CV to express themselves will facilitate the preparation of the file.
  • Despite this, unfortunately, with the change made to the Global Talent Exceptional Promise field (a talented person whom can obtain a visa with a duration of up to 5 years) only the applicants that are at the beggining of their career will be considered, which makes the Global Talent Exceptional Talent field (a talented person whom can apply to indefinite leave to remain within only 3 years of their application), which is more difficult to get accepted for many applicants. left the field without an alternative.
  • In addition, the requirement that the institutions writing the letters for the three reference letters requested must have worked with the applicant before (“2 must be from well-established arts and culture organizations that they have worked with” is replaced by “2 must be from well-established arts and culture” organizations that the applicant has worked with”) has been brought into a clear line. Accordingly, applicants must have worked with at least one well-known institution based in the UK.

         The changes will take effect from April 12.

Polis Registration System Is Repealed 


According to the new change that was announced on 5 August 2022, the requirement for every adult over the age of 16 within the UK to register with the Police under the Immigration Rules is lifted. From now on, any change in your personal information will now be reported directly to the Home Office instead of the police.

It is no longer needed to show your old police registration certificate to officers. Also, police registration document will no longer be among the documents required when applying for a residence permit.

No fee will be refunded to those who have already registered, as the fee request made at registration is requested for the transactions made during your application.

If you already have a police registration appointment that you have not attended yet, you do not need to attend your appointment anymore as this process is generally suspended.

Since registration is no longer required, any changes you make from now on will be made directly through the link determined by Home Office.

Sponsorship Classes

When it comes to Licensing and Sponsorship, we can talk about two sponsorship licenses, ‘A’ and ‘B’. When your license application is approved, you will have a class ‘A’ license. In this way, you can issue a Sponsorship Certificate (Cos) number and obtain sponsorships for the person you want to employ. However, you are subject to various audits during the period when your license is valid. Your license may be downgraded to class ‘B’ if you fail to meet the adequate requirements in these audits. While you have a B license, you can continue to employ existing staff that you are a sponsor of, but you cannot hire new staff. To upgrade your license back to class A, you will need to request an action plan from the Home Office for £1,476. If you fail to complete the necessary steps, your license may be revoked.

Sponsorship Application Form

After you decide which type of license to proceed from, it is expected that you will be able to meet the requirements of the route you are applying for a license. The requirements mentioned here may vary depending on the license you are applying for. But basically, what is expected of you is that you have an active company in the UK, and you don’t have a sponsor license that has been revoked in the last 12 months. If you meet these two conditions, we will start filling out the sponsorship application form. When managing the licensing process, we will use a system called SMS. In order to use the system effectively, you must assign authorized people who use this system for your company. First, an ‘Authorizing Officer” should be appointed to the highest level of responsibility for your company. The most competent person in your company should be the authorizing officer because this person is expected to be responsible for the entire team. In addition, there needs to be a ‘Key Contact’ who will ensure process-related communication between the Home Office and your company. You can appoint an immigration consultant who is an OISC (Office of Immigration Services Commissioner) Level 1 User as the chief responsible officer. When necessary, we provide this service to you. After making the necessary assignments through the system, we can pay your application fee and start preparing the documents you need to submit to the Home Office in the future process. During the licensing and sponsorship period, your documents must be organized with great care and meticulousness. To be clear, getting affirmative results at the end of the application depends on how carefully you conducted the process.

The Sponsorship Certificate (Cos) Number required for the UK visa sponsorship 

After obtaining your company’s license, you can easily sponsor your employees and start the official process by assigning them a Sponsorship Certificate (Cos) certificate. This document can be issued by a company that has a Sponsorship License. The Sponsorship Certificate is an electronic certificate, not a document that you will receive physically. Each certificate has a special number that an employee can use to apply for a visa. When you assign the certificate to an employee, your employee must use the certificate to apply for a visa within 3 months.

High Potential Individual Visa

We Examine the High Potential Individual Visa Which is One of the Visa Types Enforced by the UK Government

High Potential Individual route, which entered into force with the guidance dated May 30, 2022, offers the opportunity to live in the UK according to your diploma status. UK Government Launches Three New Visa Routes

With the new Statement of Changes in Immigration Rules which proposes the most significant changes to the UK’s current points-based immigration system since its inception on 1 January 2021, will enure on 11 April 2022

Included within the changes are the introduction of 3 new points-based immigration categories; Global Business Mobility, High Potential Individual and the Scale-up visa routes. There were also minor amendments to existing routes, but for the purpose of this alert, we take a closer look at the new categories and what it means for sponsors and individuals.

Global Business Mobility

The Global Business Mobility routes will consist of a number of new sponsored categories for businesses that are seeking to either establish a presence in the UK, transfer overseas staff to the UK, or come to the UK for a specific business purpose. There will be five sub-categories to this route, four will replace existing visa categories, and the remaining category will create a new provision for secondments.

  1. Senior or Specialist Worker: This visa category will replace the Intra-Company Transfer route. This category will be appropriate for senior managers or specialist employees who are being assigned to a UK business which is linked by common ownership to the overseas employing company.
     
  2. Graduate Trainee: This visa category will replace the Intra-Company Graduate Trainee route. This category will be for workers on a graduate training course which leads to a senior management or specialist position and who are required to undertake a work placement in the UK.
     
  3. UK Expansion Worker: This visa category will replace the Sole Representative of an Overseas Business route (however will remain open for Media Representatives and those already on Sole Rep visas extending or applying for ILR). This visa route will be for specialist or senior employees who are being assigned to the UK to assist with the overseas business’s expansion to the UK.
     
  4. Service Supplier: This visa category will replace contractual service providers and independent professional persons in the Temporary Worker – International Agreement route. This route will be for overseas workers coming to the UK to provide a service that is in line with a UK trade commitment.

5. Secondment Worker: This new route will be for workers who are being seconded to the UK as part of a high value contract or investment by their employer overseas.
 

The key elements of the Global Business Mobility visa are that employers will still have to sponsor workers to come to the UK to fulfil specific work purposes. The Global Business Mobility visa follows the points based system and individuals are required to score points ranging from 40 to 60 points depending on the sub-category being applied for.

Scale-up visa

The Scale-up visa will allow individuals that have a sponsored job offer from an authorised UK scale-up company to qualify for a ‘fast-track visa’. To register for this route, a company will need to demonstrate they have an annualised growth of at least 20% for the previous 3-year period in terms of turnover or staffing and have a minimum of 10 employees at the start of the 3-year period. We await further details on exactly what the registration process will entail for companies looking to sponsor under this route.

High Potential Individual 

The High Potential Individual route is aimed at graduates from the top-50 Universities across the world who wish to come to the UK to undertake full-time employment or self-employment work or seek employment opportunities.

Individuals must have been awarded within the last 5 years either a bachelor’s or postgraduate degree qualification from one of the top global universities which is published in the Home Office’s ‘Global Universities List’. The list will be compiled on an annual basis and will include the top 50 universities in at least two of the following ranking systems:
 

  1. Times Higher Education World University Rankings;
  2. Quacquarelli Symonds World University Rankings;
  3. The Academic Ranking of World Universities.

New Travel Rules And Vaccination Update

The traffic light system, which includes the red, amber and green country lists, which the UK government has been applying for a long time within the scope of Covid-19 travel restrictions, has left its place to a new regulation as of 4 October. As we mentioned in our previous newsletter, people who will enter the UK directly from Turkey will no longer be subject to mandatory hotel quarantine. Nevertheless, what are the new travel rules or does the quarantine obligation continue? We will be sharing in detail in the rest of this article.

The rule behind the new travel system is simple: being fully vaccinated and travelling a minimum of 14 days after the second dose. 

As you know, the UK government approved the vaccination programs of a limited number of countries such as European Union countries and the USA. Unfortunately, Turkey was not among these countries, which meant even people who had received a double dose in Turkey could not overcome travel barriers in the UK. 

We have perfectly splendid news on this subject. Yesterday, October 7, 2021, according to the statement, as of October 11, the vaccination certificate of the passengers who were vaccinated in Turkey will be accepted. According to this;

  • Passengers with 2 doses of Oxford/AstraZeneca, Pfizer BioNTech, Moderna, or a single dose of Janssen vaccine and 14 days past their last vaccination are only subject to the new rules. The day of vaccination is not included in the 14 days. People who have recently had Covid and have become immune are also subject to these rules.
  • Passengers who meet the above conditions can enter the UK with a digital Covid certificate by purchasing the 2nd day test and filling out the travel form. We will be explaining in detail.
  • For passengers who have 2 doses of vaccine (,f 14 days have passed since their second dose) the obligation to quarantine for 10 days, to have PCR test within 72 hours of travel and to take the test on the 8th day will be lifted as of 11 October.
  • Passengers who want to prove their vaccination status must have a Digital Vaccination Certificate showing the following details in English; name & surname, date of birth, brand and manufacturer of the vaccine administered, the date the dose was administered for each dose, and the country in which the vaccine was administered.

So, what does it mean that the vaccines applied in Turkey are valid?

Good news, especially for those wishing to travel to the UK on a visitor visa or other short-term visas. 

Since the vaccines made in Turkey were not accepted during the period when Turkey was on the amber list, it was obligatory for the traveling passengers to stay in quarantine at the address they declared for 10 days. However, announcing that their approved vaccination lists are being updated, the UK government has indirectly stated that it has opened its doors to visitor visas with the new travel rules.

Within the scope of the new travel rules, countries are listed in two separate categories; these are the countries on the red list and the rest of the world. Since Turkey is no longer on the red list, we will talk about entry requirements for the countries in ‘rest of the world’ list.

If you have been fully vaccinated and are traveling to the UK, consider the following rules.

Things to do before your trip:

– Buying the Day 2 test, this test must be applied on the second day of your entry to the country.

– Completing a passenger locator form (PLF) within 48 hours of your entry to the country.

Things to do after entering the UK:

– Applying the Day 2 day test you have bought before the trip on the second day of your arrival.

Note: Even if you are staying in the UK for less than 2 days, you still must purchase this test and apply if you are still in the UK on the second day of your arrival.

You can find the list of countries of which vaccination programs are accepted by the UK.

If you have not yet received your second dose of vaccine or have never been vaccinated, the following rules apply when traveling to the UK.

Things to do before your trip:

– Have a PCR test and get a Covid-19 negative result within 3 days of your arrival in the UK.

– Buying Day 2 and 8 tests 

– Completing the passenger travel form.

Things to do after entering the UK:

– To stay in quarantine for 10 days at your home or at the address you declared to stay

– To apply the tests that you have bought before the trip on the second and eighth days of your arrival.

Frequently asked Questions:

• Can I apply for a visitor visa?
You can apply for a visitor visa and after receiving it you can travel to the UK without quarantine if you prove that you have a double dose of vaccination.

• Are the travel rules valid for individuals under the age of 18?
These rules apply to all children and teenagers over the age of 4, even if they can prove they have been vaccinated. E.g., Buying and applying the Day 2 test.

• I am fully vaccinated, but in different countries. Will I still be treated as a fully vaccinated?
Passengers with different doses of vaccines in countries approved by the Home Office are subject to UK travel rules for those who have been vaccinated.

• I had a single dose of vaccination, what rules apply?

Persons who have received a single dose of vaccination and have not been in one of the countries on the red list in the last 10 days before their trip are subject to the rules in the article “If you have not yet received your second dose of vaccination or have never been vaccinated”.

• Do I have to stay in quarantine until the second day test?

If you have been vaccinated with a double dose and your vaccination and country is accepted by the UK, your obligation is only to apply this test on the second day.

Otherwise, if you do not have a vaccine or your vaccines are not accepted, you must remain in quarantine for 10 days.

• I will stay less than two days, do I still need to take a test?
Yes, even if you stay for less than two days, you still need to buy a test.

• Can I enter the country even if I have had Covid-19?

There is no restriction on this topic unless you are not trying to travel during your illness.

New visa routes you need to check if you wish to have a residency in the UK - 2021

The route was formerly known as the ‘Exceptional Talent’ visa; however, both its name and partially the application process have changed.
