How Do Previous Refusals Affect a New UK Visitor Visa Application?

A previous refusal does not automatically mean that a new application will also be unsuccessful. However, where an applicant has a history of refusals, the new application may be subject to greater scrutiny and may lead to requests for additional evidence. It is therefore essential to address the reasons for the previous adverse decisions clearly and logically in the new application.

Why Are UK Visitor Visa Applications Refused?

There is no points-based assessment or fixed financial requirement for a UK Standard Visitor visa. Instead, each application is considered as a whole. The decision-maker will assess whether the applicant is a genuine visitor, whether they have sufficient and accessible funds to cover the cost of the visit, and whether they have sufficiently strong ties to their country of residence to demonstrate that they intend to leave the UK at the end of their visit.

Most refusals arise from concerns in three key areas: financial circumstances, the purpose of the visit, and the applicant’s intention to return to their country of residence.

What Does “The Evidence Does Not Support the Declaration” Mean?

Visitor visa refusal decisions often follow a familiar pattern. The decision-maker may not directly dispute what the applicant has stated but may instead conclude that the declaration has not been sufficiently supported by documentary evidence. In other words, the decision may not say, “You do not have this income,” but rather, “The documents provided do not demonstrate the income you have declared.”

Even where an applicant’s financial circumstances are more than sufficient to fund the proposed visit, inconsistencies between the amounts declared in the application form, the transactions shown in their bank statements, and the supporting evidence can create a significant risk of refusal.

Differences Between Official Document Formats in Different Countries

Another issue that may arise for Turkish nationals concerns differences between the official documentation systems in Turkiye and the UK. For example, certain types of income in Turkiye are taxed at source, meaning that the individual may not be required to submit a separate annual tax return. Similarly, an active shareholding or board membership in a company may not appear in the individual’s social security employment record.

If the absence of such documents or relevant entries is not properly explained, the decision-maker may conclude that the evidence does not establish a clear connection between the applicant’s declared income and their employment or business activities.

It is therefore crucial to identify which information a UKVI decision-maker would ordinarily expect to see, recognise where the documents issued under another country’s system may not contain that information, and explain the difference on the correct legal and factual basis.

What Were the Main Risks in This Case?

In this case, the applicant had previously submitted four visitor visa applications, all of which had been refused. As a first step, each refusal decision was reviewed separately to identify the pattern of recurring concerns.

The applicant’s spouse and children were British citizens. This placed the applicant in a potentially disadvantageous position when UKVI assessed whether they were likely to leave the UK at the end of the proposed visit.

Although the applicant had sufficient financial resources to fund the visit, the source and regularity of their income also needed to be presented in a clear and comprehensible manner.

Given the four previous refusals, the new application was likely to be examined more closely and could potentially lead to a request for further evidence. The concerns raised in the previous decisions therefore needed to be addressed on a coherent and well-supported basis.

How Was the Application Reconstructed?

Once these issues had been identified, the application was rebuilt using a comprehensive strategy:

  • The applicant’s financial circumstances were presented through regular income and accessible savings, with the figures aligned precisely with the transactions shown in the bank statements. The sources of significant incoming transfers were also documented and explained.
  • The declarations made in the application form, including income, savings and anticipated travel costs, were presented in full alignment with the supporting evidence.
  • The applicant’s ties to Turkiye—including their established life, family circumstances and economic connections—were evidenced to demonstrate their reasons and motivation for returning after the visit.
  • Relevant systemic differences between Turkiye and the UK, including differences relating to income declarations and official records, were explained on the correct legal and factual basis.

The Outcome
